These Terms of Service (“Terms”) are intended to explain how Decamicron Labs, LLC (“Decamicron Labs,” “We,” or “Our”) handles live-animal shipments, order issues, guarantees, warranties, and related customer claims. We work carefully to ship healthy, conditioned Specimens, but live aquatic organisms are inherently variable biological animals. Shipping, acclimation, quarantine, tank conditions, compatibility, and individual behavior can all affect outcomes after delivery. These Terms are intended to provide a fair and predictable process for customers while also allowing Decamicron Labs to verify claims and distinguish transit-related issues from post-delivery husbandry, compatibility, or environmental issues.
Nothing in these Terms limits any non-waivable rights a customer may have under applicable law.
1. Definitions
For purposes of these Terms:
“Specimen” means any live animal, coral, invertebrate, or other living aquatic organism sold by Decamicron Labs.
“DOA” means “Dead on Arrival.”
“Extended Guarantee” means any optional or included short-term survival guarantee expressly stated at the time of sale.
“Store Credit” means non-refundable credit redeemable exclusively with Decamicron Labs.
Coverage under any Extended Guarantee applies only where expressly stated at the time of purchase. No Extended Guarantee is implied merely by the sale of a Specimen.
2. DOA Policy
- All shipments are covered by the following DOA policy unless otherwise stated in writing. To qualify for DOA coverage, the following conditions apply:
- The shipment must be received on the first delivery attempt.
- The customer must contact Decamicron Labs within two (2) hours of delivery confirmation regarding any deceased, nonviable, or significantly compromised Specimen.
- The customer must provide clear photo or video documentation showing the condition of the Specimen. When possible, documentation should show the Specimen in the unopened shipping bag before acclimation.
- If a Specimen appears deceased or clearly nonviable upon arrival, the customer should still make reasonable efforts to acclimate and recover the Specimen after documentation has been collected, unless doing so would be plainly futile or unsafe. Many aquatic species may lie on their sides, breathe heavily, lose color, remain motionless, pretend to be dead, or appear severely stressed after shipping.
- The customer must freeze all deceased Specimen(s) and retain them in frozen condition for a minimum of fourteen (14) calendar days following the claim, unless Decamicron Labs confirms in writing that retention is not necessary.
- Decamicron Labs may request additional photographs, video, water-parameter information, or other information reasonably needed to evaluate the claim.
- Decamicron Labs may require the Specimen to be returned overnight using insulated packaging and ice packs as a condition of coverage, particularly for high-value claims, unusual losses, or claims requiring additional verification. Failure to comply with a reasonable preservation, documentation, or return request may void coverage.
- DOA coverage does not apply to losses, delays, or damages resulting from circumstances outside the direct control of Decamicron Labs, including but not limited to:
- delivery delays;
- missed deliveries;
- refusal of delivery;
- weather events;
- carrier mishandling;
- acts of God;
- natural disasters;
- customer absence;
- incorrect or incomplete shipping information provided by the customer;
- failure to retrieve a held package promptly;
- or any other shipping or transit interruption beyond Our control.
- Decamicron Labs may deny a claim where submitted documentation appears altered, edited, incomplete, inconsistent, misleading, or otherwise unreliable. We may also in Our sole and absolute discretion refuse future sales, guarantees to customers with unusually high claim rates, repeated shipping losses, repeated compatibility issues, or other circumstances that make future shipments unusually risky.
- Approved DOA claims will be resolved through one or more of the following, as determined by Decamicron Labs:
- replacement;
- Store Credit;
- partial Store Credit;
- or another exception approved by Decamicron Labs in writing.
- Replacement shipments may require the customer to pay additional shipping charges. Unless otherwise required by law or expressly approved by Decamicron Labs, cash refunds are not issued for DOA claims.
- Any replacement Specimen provided under this DOA policy is covered only by the standard DOA policy upon reshipment, unless Decamicron Labs expressly agrees otherwise in writing. Decamicron Labs may, on a case-by-case basis, approve refunds, replacements, credits, fee waivers, or other exceptions without requiring strict compliance with every requirement in this DOA policy. Any such exception is provided as a courtesy and does not waive the DOA policy or create an obligation to provide the same exception in any future transaction or claim.
3. Extended Guarantee Policy
- Certain Specimens may be sold with an Extended Guarantee where expressly stated at the time of sale. Unless otherwise stated in writing, the following conditions apply to all Extended Guarantees.
- The Specimen must remain in a fully cycled, established, and appropriate aquarium system. The customer is responsible for maintaining appropriate husbandry conditions, including but not limited to:
- undetectable ammonia and nitrite;
- salinity between 1.02 and 1.028;
- appropriate temperature for each species;
- alkalinity between 6dkh and 15dkh and a pH between 8.0 and 8.4;
- appropriate filtration;
- appropriate tank size;
- adequate oxygenation and water movement;
- appropriate water quality;
- compatibility with tank inhabitants;
- and an environment suitable for the particular species.
- Decamicron Labs may require pre-shipment review of the receiving aquarium, including photographs, video, water parameters, tank age, tankmate information, or other husbandry details, as a condition of Extended Guarantee eligibility for certain Specimens.
- Extended Guarantee coverage does not apply to losses caused or materially contributed to by customer husbandry, environmental conditions, tank-mate compatibility issues, or events occurring after delivery that are outside Decamicron Labs’ control. This includes, but is not limited to, poor filtration, unstable water parameters, inadequate tank size, tank-mate aggression, predation, harassment, injury from other livestock, jumping, equipment failure, medication error, acclimation error, or failure to maintain appropriate quarantine or holding conditions.
- If a Specimen appears ill, stressed, or otherwise compromised after delivery, customers are encouraged to contact Decamicron Labs as soon as reasonably possible so that We may help review the situation and discuss possible treatment options.
- Because medications, chemical treatments, copper, antibiotics, antiparasitics, and other therapeutic agents can affect Specimen health and complicate claim evaluation, their use may void coverage under the Extended Guarantee unless expressly preapproved by Decamicron Labs in writing prior to treatment. Decamicron Labs may authorize, recommend, or permit treatments without voiding coverage, and any such authorization applies only to that particular case and does not create an obligation to provide the same exception in any future transaction or claim, unless otherwise stated in writing.
- Decamicron Labs may request photographs, videos, water-parameter readings, acclimation information, feeding history, tank history, quarantine information, or other husbandry information before approving a claim.
- If a claim is submitted, Decamicron Labs requires the Specimen to be preserved and frozen for at least fourteen (14) calendar days. Decamicron Labs may request the preserved Specimen to be returned, potentially at the customer’s expense, through overnight shipping using insulated packaging and ice packs as a condition of coverage. Failure to comply with documentation, preservation, or return requests may void coverage.
- Decamicron Labs may deny a claim in its sole and absolute discretion where submitted documentation appears altered, edited, incomplete, inconsistent, misleading, or otherwise unreliable.
- Approved claims under an Extended Guarantee will be resolved through one or more of the following, as determined by Decamicron Labs in its sole and absolute discretion:
- replacement;
- Store Credit;
- partial Store Credit;
- or another exception approved by Decamicron Labs in writing.
- Replacement shipments may require the customer to pay additional shipping charges. Unless otherwise required by law, cash refunds are not issued for Extended Guarantee claims.
- Any replacement Specimen provided under an Extended Guarantee is covered only by the standard DOA policy upon reshipment, unless Decamicron Labs expressly agrees otherwise in writing. Extended Guarantee coverage does not automatically restart, extend, or apply to a replacement Specimen.
- Decamicron Labs may, on a case-by-case basis, approve refunds, replacements, credits, fee waivers, or other exceptions without requiring strict compliance with every requirement in this Extended Guarantee policy. Any such exception is provided only as a courtesy and does not waive the Extended Guarantee policy or create an obligation to provide the same exception in any future transaction or claim.
4. Feeding, Health, Appearance, Behavior, and Compatibility Disclaimer
- All Specimens are observed feeding at Decamicron Labs prior to shipment unless otherwise disclosed. Upon request before shipment, Decamicron Labs may provide a video of the exact Specimen feeding at Our facility when reasonably available.
- However, live aquatic organisms are inherently variable biological animals. Decamicron Labs does not guarantee:
- continued feeding response after arrival;
- long-term survivability;
- coloration;
- pattern development;
- morphology;
- behavior;
- temperament;
- compatibility;
- sex;
- breeding capability;
- absence of deformities;
- absence of genetic abnormalities;
- absence of latent or subclinical disease;
- or future health condition.
- Transit stress may cause temporary or permanent changes in feeding behavior, coloration, activity level, temperament, aggression, hiding behavior, territoriality, or social behavior. Some species and individuals are inherently aggressive, territorial, venomous, defensive, predatory, delicate, easily stressed, or otherwise difficult to predict. Individual personality and behavior may also change after shipping, acclimation, maturation, pairing, dominance shifts, environmental change, or introduction to new tank mates. Decamicron Labs cannot predict or guarantee future compatibility, aggression level, temperament, or behavior of any Specimen after delivery.
- The customer is solely responsible for determining whether a Specimen is appropriate for the customer’s aquarium, household, skill level, existing livestock, pets, children, and intended use. Customers should research species-specific risks before purchase, including risks associated with venom, spines, teeth, toxins, jumping, aggression, predation, size, diet, territoriality, and handling sensitivity.
- Any courtesy exception related to feeding response, physical abnormalities, aesthetic concerns, behavioral concerns, aggression, compatibility, or other post-delivery concerns is entirely case-specific and does not create an ongoing obligation or future precedent.
5. Customer Responsibilities, Safety, and Assumption of Risk
- The customer assumes all risks associated with receipt, handling, acclimation, quarantine, housing, compatibility, feeding, maintenance, and ongoing care of any Specimen after delivery.
- Live aquatic organisms may bite, sting, scratch, puncture skin, envenomate, release toxins, carry pathogens, damage aquarium equipment, injure or kill other livestock, injure pets, or otherwise cause unexpected harm. Some Specimens may be dangerous to handle directly or indirectly. The customer is responsible for using all appropriate care, protective equipment, quarantine practices, containment, tools, and handling procedures.
- To the maximum extent permitted by law, Decamicron Labs shall not be liable for any injury, illness, death, property damage, aquarium damage, equipment damage, livestock loss, pet injury, pet death, human injury, household damage, water damage, business loss, emotional distress, veterinary cost, medical cost, remediation cost, lost profits, or other direct or indirect harm arising out of or relating to a Specimen after delivery, including harm caused by aggression, venom, toxins, spines, bites, disease, parasites, escape, jumping, predation, incompatibility, or customer handling.
- The customer is solely responsible for complying with all applicable laws, rules, regulations, permits, import restrictions, possession restrictions, and local requirements relating to the purchase, receipt, possession, transport, quarantine, resale, or keeping of any Specimen.
6. Order Acceptance, Cancellations, Pricing, and Availability
- Decamicron Labs may refuse, limit, hold, delay, or cancel any order at any time and for any lawful reason, including but not limited to:
- Specimen health concerns;
- inventory discrepancies;
- pricing errors;
- description errors;
- suspected fraud;
- shipping or weather concerns;
- regulatory or permitting concerns;
- customer history;
- animal welfare concerns;
- customer suitability concerns;
- or operational limitations.
- By submitting an electronic order form, completing checkout, transmitting payment, or otherwise attempting to place an order, the customer is submitting a request and offer to purchase goods from Decamicron Labs subject to verification, review, availability, Specimen health considerations, shipping feasibility, fraud screening, and acceptance by Decamicron Labs. Submission of an order, transmission of payment information, or receipt of an automated order confirmation does not, by itself, constitute acceptance of the order by Decamicron Labs.
- An order is not deemed accepted until We confirm acceptance through written communication, shipment of the order, or another affirmative act of acceptance. Decamicron Labs may cancel accepted or unaccepted orders prior to shipment in its sole and absolute discretion where appropriate.
- Decamicron Labs may request information about the receiving aquarium before accepting, shipping, or continuing with an order. This may include photographs, video of the aquarium system, water-parameter information, tank age, livestock list, filtration information, quarantine plans, or other husbandry information reasonably relevant to Specimen welfare, compatibility, or guarantee eligibility. Failure to provide requested information, or provision of information suggesting that the receiving system is unsuitable, may result in Decamicron Labs refusing, holding, delaying, modifying, or canceling the order prior to shipment.
- Although Decamicron Labs’ website may be accessible worldwide, We make no representation that Specimens thereon are lawful, appropriate or available for use in locations outside the United States of America, and ordering Specimens from territories where they are illegal is prohibited. Customers who choose to access the website from locations outside the United States of America do so on their own initiative and are responsible for compliance with all local laws. Any offer for any product, service, and/or information made in connection with the website is void where prohibited.
- Requests to cancel, withdraw, reverse, or materially modify an order after submission are subject to a cancellation fee equal to ten percent (10%) of the total order value, regardless of whether the order has already been formally accepted by Decamicron Labs. This fee is intended to compensate for administrative processing, Specimen reservation, holding, preparation, fraud screening, scheduling, and operational costs incurred after order submission. If We cancel an order prior to shipment, the cancellation fee will generally be waived. Orders cannot be cancelled once shipped.
- Decamicron Labs may waive cancellation fees or provide another exception on a case-by-case basis. Any such exception is provided only as a courtesy and does not waive these Terms or create an obligation to provide the same exception in any future transaction.
- The customer is responsible for any taxes imposed on the sale of Specimens and other products and applicable taxes will be added to the amount charged for such Specimens and other products purchased through the website. The customer agrees to indemnify, defend and hold Decamicron Labs, its affiliates and its and their respective officers, directors, employees, agents, licensors, representatives, advertisers, service providers and suppliers harmless from and against any and all claims, actions, losses, expenses, damages and costs (including reasonable attorneys' fees), resulting from customer’s failure to pay any taxes to the proper governmental authorities.
7. Typographical Errors, Product Descriptions, and Website Information
- Decamicron Labs attempts to provide accurate product descriptions, availability information, pricing, photographs, videos, and other website content. However, errors may occur. For instance, with respect to Specimens, we have tried to accurately display colors, but depending on the specifications and settings of your computer and its monitor, the colors you see might not accurately depict the actual colors of the Specimen.
- In the event that a Specimen, product, shipping charge, guarantee, price, availability status, description, photograph, or other website content is listed incorrectly, Decamicron Labs may refuse, correct, hold, or cancel any order affected by the error, including after an order has been submitted or payment has been authorized. If payment has already been captured for an order that is cancelled due to an error, Decamicron Labs will issue the appropriate refund or reversal for the cancelled portion of the order.
- Certain weights, measures and similar descriptions are approximate and are provided for convenience purposes only. In addition, variations in live Specimens are typical and very common, and Specimen weights and measurements can vary slightly from the specific information set forth on Our website. Photographs and videos may be affected by lighting, stress coloration, screen settings, camera settings, growth, age, shipping stress, and natural variation. Unless expressly stated otherwise, such as in a WYSIWYG “What You See Is What You Get” listing, images may be representative rather than a guarantee of exact future appearance. To be clear, minor Specimen variations in color, weights and measurements will not be considered as resulting in Specimens being deemed defective.
8. Refunds, Store Credit, Replacements, and Chargebacks
- Except where prohibited by law or expressly approved by Decamicron Labs in writing, all sales are final and non-refundable.
- Customer remedies are limited to the remedies expressly provided in these Terms, including replacement, Store Credit, partial credit, or another exception approved by Decamicron Labs in writing.
- Store Credit is non-refundable, non-transferrable, has no cash value, and may be used only with Decamicron Labs unless otherwise required by law.
- Because many Specimens sold by Decamicron Labs are unique individual animals with non-repeatable coloration, patterning, morphology, or other aesthetic characteristics, exact replacements are often impossible. For WYSIWYG (“What You See Is What You Get”) Specimens and other individually photographed livestock, approved claims will generally be resolved through Store Credit, partial Store Credit, or other remedy determined by Decamicron Labs.
- Customers are encouraged to contact Decamicron Labs promptly with any order concern so that the issue can be reviewed and addressed in good faith. A payment dispute, chargeback, or similar claim does not expand the customer’s remedies, extend any claim deadline, waive any requirement in these Terms, or create coverage where coverage would not otherwise exist under these Terms.
- Decamicron Labs may suspend or decline future sales, guarantees, warranties, or replacement shipments while a payment dispute, chargeback, suspected fraud issue, or unresolved claim remains pending in Our sole and absolute discretion.
9. Limitation of Liability
- To the maximum extent permitted by law:
- Decamicron Labs shall not be liable for indirect, incidental, consequential, exemplary, punitive, special, emotional-distress, reputational, business-interruption, lost-profit, veterinary, medical, remediation, replacement-system, or property-damage losses arising out of these Terms however incurred, whether such liability is asserted on the basis of contract, tort (including negligence or strict liability), or otherwise, even if such party is advised of the possibility of such damages in advance by the customer.
- Customer remedies are limited to replacement, Store Credit, partial Store Credit, or another written exception approved by Decamicron Labs.
- Under no circumstances shall Decamicron Labs’ total liability ever exceed the original purchase price paid for the specific Specimen(s) giving rise to the claim.
- Decamicron Labs shall not be liable for any harm, injury, loss, death, disease, parasite introduction, aggression, predation, compatibility issue, aquarium crash, water damage, equipment damage, livestock loss, pet injury, pet death, human injury, household damage, business loss, emotional distress or other damage arising after delivery of Specimens.
- The customer understands that there are risks associated with purchasing and receiving Specimens from Decamicron Labs, such as physical and/or psychological injury, pain, suffering, illness, death, or economic loss. The customer assumes all risks associated with acclimation, quarantine, compatibility, environmental conditions, husbandry practices, handling, containment, and ongoing care of Specimens after delivery.
- Nothing in this Section limits liability that cannot legally be limited under applicable law.
- Except as expressly set forth herein, Decamicron Labs’ website and all materials, and services thereon are made available on an "AS IS" and "AS AVAILABLE" basis, without any representation or warranty of any kind, express or implied, or any guaranty or assurance the website will be available for use, or that all website features, functions or operations will be available or perform as described. Except as specifically set forth herein in writing, we expressly disclaim all representations and warranties of any and every kind, express or implied, with respect to any and all Specimens, including, but not limited to, any warranty of merchantability or of fitness for a particular purpose.
10. Indemnification
- To the maximum extent permitted by law, the customer agrees to indemnify and hold harmless Decamicron Labs, LLC, its owners, members, managers, employees, contractors, agents, affiliates, successors, and assigns from and against claims, losses, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:
- the customer’s breach of these Terms;
- the customer’s misuse, mishandling, or improper care of a Specimen;
- the customer’s aquarium, quarantine, acclimation, or husbandry practices;
- injury or damage caused by a Specimen after delivery;
- the customer’s violation of applicable law or regulation;
- illegal possession, resale, transfer, transport, release, or import/export of any Specimen;
- or claims by third parties filed against Decamicron Labs arising from the customer’s possession, handling, resale, transfer, or use of any Specimen.
- This obligation does not apply to the extent a claim is caused by Decamicron Labs’ own negligence, willful misconduct or non-waivable legal responsibility under applicable law.
11. Force Majeure and Events Outside Decamicron Labs’ Control
Decamicron Labs shall not be responsible for delay, nonperformance, loss, damage, or failure to fulfill any obligation caused by events outside its reasonable control, including but not limited to weather, carrier disruption, airport disruption, import delay, collection limitation, supplier issue, disease outbreak, quarantine restriction, government action, permit delay, natural disaster, power outage, labor disruption, transportation interruption, civil unrest, act of war, act of terrorism, pandemic, epidemic, or other event beyond the reasonable control of Decamicron Labs.
12. Website Use, Intellectual Property, and Third-Party Links
- All website content, including text, photographs, videos, graphics, logos, designs, product descriptions, policies, and other materials, and all intellectual property rights therein is owned by or licensed to Decamicron Labs unless otherwise stated. Customers and visitors may view and print reasonable portions of the website for personal, non-commercial use related to purchasing from or communicating with Decamicron Labs. Any other copying, reproduction, modification, distribution, scraping, publication, or commercial use is strictly prohibited without prior, written permission.
- Visitors may not use the website for unlawful, abusive, fraudulent, defamatory, harassing, misleading, or harmful purposes. Visitors may not attempt to interfere with website operation, security, payment systems, customer accounts, or related services.
- The website may contain links to third-party websites, services, payment processors, shipping carriers, embedded tools, or other external resources. Decamicron Labs does not control and is not responsible for third-party websites, services, policies, security practices, content, or availability. Accessing third-party websites or services is at the customer’s own risk.
- Use of this website is also governed by the Decamicron Labs Privacy Policy, which describes how personal information is collected, used, processed, and disclosed.
13. Communications and Electronic Records
- By placing an order, creating an account, submitting a form, or contacting Decamicron Labs electronically, the customer agrees that Decamicron Labs may communicate by email, website notice, order message, phone, text message where permitted, or other reasonable communication method. Electronic communications, confirmations, records, policies, and notices satisfy any requirement that communications be provided in writing, to the extent permitted by law.
- The customer is responsible for providing accurate contact information and monitoring communications relating to orders, claims, shipping, weather holds, delivery instructions, and requirements under these Terms.
14. Claim Deadline
- To the maximum extent permitted by law, any claim, dispute, or cause of action arising out of or relating to a purchase, shipment, Specimen, guarantee, website use, communication, or transaction with Decamicron Labs must be commenced within one (1) year after the event giving rise to the claim.
- This claim deadline does not shorten any deadline that cannot legally be shortened under applicable law.
15. Arbitration and Venue
- Any dispute, claim, or controversy arising out of or relating to: (i) any Specimen purchase, sale, shipment, delivery, livestock condition, quarantine process, acclimation guidance, guarantee, representation, communication, or transaction involving Decamicron Labs, LLC; or (ii) the use of this website or any products or services provided by Decamicron Labs, LLC, including any claim based in contract, tort, negligence, misrepresentation, fraud, statute, consumer protection law, warranty law, or other legal or equitable theory, shall be resolved exclusively through final and binding arbitration, except for qualifying individual small-claims matters as described below.
- This arbitration provision shall be governed by the Federal Arbitration Act (“FAA”) and applicable federal arbitration law.
- The arbitration shall be administered by the American Arbitration Association (“AAA”) under its applicable consumer arbitration rules then in effect, except as modified by these Terms.
- The seat and exclusive venue of the arbitration shall be Baltimore City, Maryland, USA, and the arbitration shall be decided by one (1) arbiter. The parties agree that any action relating to enforcement of this arbitration provision, compelling arbitration, confirmation of an arbitration award, or any ancillary court proceeding shall be brought exclusively in the state or federal courts located in Maryland, and the parties consent to the personal jurisdiction of such courts.

To the maximum extent of the law, the parties expressly waive any right to:
- trial by jury;
- participation in any class action;
- participation in any consolidated, collective, or representative proceeding;
- or acting as a private attorney general.
- All claims must be brought solely in an individual capacity.
- Either party may elect to bring an individual claim in a court of competent jurisdiction for qualifying small-claims matters.
- Each party shall bear its own attorneys’ fees and costs unless otherwise required by applicable law or awarded by the arbitrator. Nothing in these Terms limits any non-waivable consumer rights under applicable law.
- Before initiating arbitration, the customer must provide written notice of the dispute to Decamicron Labs, LLC and allow thirty (30) days for good-faith resolution efforts.
- If any portion of this Section is determined to be invalid or unenforceable, the remaining portions shall remain in full force and effect, except that if the class action waiver is found unenforceable, this entire arbitration provision shall be null and void to the extent required by applicable law.
16. Severability, No Waiver, and Entire Agreement
- If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.
- Decamicron Labs’ failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right. Any exception, courtesy credit, refund, replacement, fee waiver, or other accommodation is case-specific and does not create a continuing obligation, course of dealing, or precedent for future transactions.
- These Terms, together with any written product-specific terms, written guarantee terms, checkout terms, and the Privacy Policy, constitute the applicable agreement between the customer and Decamicron Labs for the matters addressed herein, except where different written terms are expressly agreed by Decamicron Labs.
17. Governing Law
These Terms and your use of the website shall be governed by, construed and enforced in accordance with the substantive laws of the State of Maryland applicable to contracts made, executed and wholly performed in that State.
18. Acceptance of Terms
By purchasing from Decamicron Labs, placing an order, completing checkout, submitting payment, accepting shipment, or using this website, the customer acknowledges that they have read, understood, and agreed to the applicable terms contained in these Terms.
